Tobacco marketing firm fined NT$5.2 million for giveaways

KAOHSIUNG, Taiwan -- The Kaohsiung City Government has upheld a ruling to fine a tobacco product marketing company NT$5.2 million for using colorful cards to promote sales. The fine was first meted out by the City's Health Department following a complaint filed by the anti-smoking organization John Tung Foundation in July.

The foundation charged that the supplier of tobacco products had violated the regulations by attaching well-designed and colorfully printed cards to three brands of cigarette packs as giveaways to attract buyers.

The supplier made an appeal to the city's Rules and Laws Department in an attempt to overturn the ruling. The department's seven members attending a meeting reviewing the petition held different views, but they eventually voted four to three to reject the company's appeal.

Officials said the company should pay the fine unless it decides to take the case to the Kaohsiung High Administrative Court in the southern city for a new ruling.

Health officials stressed that suppliers, distributors and retailers of tobacco products should all observe the nation's regulations against smoking hazards by refraining from promoting cigarettes or other tobacco items, including providing giveaways to customers.
