Maimed soldier awarded NT$1 mil. compensation

TAIPEI, Taiwan -- A former soldier who was heavily wounded in a training exercise during his service with the Ministry of National Defense (MND) three years ago was yesterday awarded over NT$1 million in compensation by the Taiwan High Court.

The court ordered both the Army General Headquarters and the Combined Service Force General Headquarters to compensate the man, surnamed Yeh, a total of NT$1,014,568. The judge based his decision on the severity of Yeh's injuries as well as his youth — 24 years of age — during the time of the incident. Yeh had previously sought compensation with the Taoyuan District Court but believed the amount awarded was not enough.

On Oct. 2006, when Yeh, then 24, was in the army, a fellow soldier accidentally detonated a bomb during a military exercise. The explosion injured many soldiers but Yeh was the most critically wounded; bomb debris burned large areas of his body and limbs, even piercing his liver.

Yeh's limbs were maimed by the explosion and he began to develop some adverse physical side effects. When he and the MND requested compensation with the Taoyuan District court, he was awarded NT$849,520 to cover hospital fees and as payment for his partial loss of mobility and emotional distress. Both Yeh and the MND felt the amount was insufficient and appealed to the higher court.
